J. Cruz World Yoshukai Karate — Membership Agreement and Release
CAUTION: IT IS IMPORTANT THAT YOU THOROUGHLY READ THE CONTRACT BEFORE YOU SIGN IT
This agreement is entered into between the Member named on this form (hereinafter referred to as “MEMBER”) and J. CRUZ WORLD YOSHUKAI KARATE (hereinafter referred to as “SCHOOL”) for the purposes of training lessons and instruction in Yoshukai karate techniques for the period stated herein or any renewal thereof.
a. No course certificate or belt will be granted unless payments are current. Member further understands that this contract is non-cancellable and non-assignable by the member, his/her parents or legal guardian under any circumstances.
b. Members understand that the school is supervised by instructors and reasonable care will be taken to prevent injuries and minimize accidents. It is required that the member obeys the rules of the instructor, and that no member shall practice free sparring or self-defense until he/she has been approved for the same by the instructor.
c. It has been explained to the member that the aforesaid lessons and instructions involve some physical contact with the instructor and other members which may occasionally result in accidental injury. It has also been explained to him/her that classes, practice sessions and or contests may result in the same. Member further understands and promises that in the event he/she becomes physically unable to participate herein, he/she will immediately notify the Club in writing.
d. MEMBER ASSUMES ALL RISKS OF PERSONAL INJURY. Recognizing and being aware of the aforementioned, the Member, Individually and his/her successors, heirs, executors, administrators, and assigns, expressly assumes all risk of injury, resulting either directly or indirectly from the aforementioned lessons, instructions and contests in Yoshukai Karate and hereby releases the school, its successors, and assigns, and all of its employees instructors and related persons, firms or corporations of and from every claim, loss, injury or suffering, which hereafter may be sustained as a result of such training lessons, contests, or in traveling to, participating in, or returning from any of the same.
e. The student or parent/legal guardian also understands it is his/her responsibility to purchase all personal protective equipment.
f. It is further understood that the terms and conditions of this Agreement shall remain binding upon Member even in the event of accidental personal injury to the Member’s person, and that such accidental personal injury will not limit or terminate any contractual obligation of any member to the Club in any manner whatsoever.
g. Member further acknowledges that the training, lessons and instructions in the self-defense techniques offered by and through the SCHOOL are aimed at improving both the mental and physical health of the member and involve, in addition to the physical activities called for by such training, self-discipline, self-restraint and a respect for the formalities and ceremonies which have been traditionally associated with Yoshukai karate. In connection Member undertakes and agrees: (i) To comply with all reasonable rules of the instructor both as to the physical and ceremonial aspects of training. (ii) To refrain from using Yoshukai karate to provoke or challenge innocent persons. (iii) To refrain from bringing discredit upon himself/herself or this SCHOOL by reason of improper conduct on his/her part. (iv) To uphold and protect the honor and prestige of Yoshukai, and in the event of the failure of Member to comply with terms herein, Member’s affiliation with the SCHOOL may, at the SCHOOL’s discretion, be terminated without refund of any fees previously paid by Member and without release from any of his/her obligations to SCHOOL hereunder.
h. Member acknowledges that he/she has read and understands this Agreement and will abide by all of his/her promises contained herein, and has received a copy of this Agreement. Members further acknowledge that this Agreement expresses all terms, conditions, and provisions except, as may be modified in writing and accepted by both parties.
i. I hereby agree that Yoshukai Karate is the sole and only judge of my qualifications and achievements.
j. I hereby agree not to teach Yoshukai Karate to members or nonmembers of Yoshukai Karate, for personal financial gain without written authorization by Yoshukai Karate.
k. Participants understand that J. CRUZ WORLD YOSHUKAI KARATE is independently owned and operated.
